By Sheldon L. Trubatch – This review of U.S. Supreme Court cases involving nuclear power and related ancillary issues shows a clear evolution in the bases for judicial decision making over time. As the composition of the Court has changed, it has moved from relying on federal preemption to implement Congress’s intent to promote nuclear power in favor of states’ rights in areas not directly related to health and safety matters regarding radioactivity. To justify these decisions, the Justices claimed they did not adversely impact Congress’s intent to promote nuclear power.
